How Much Earned Leave Do Teachers and Vacation Staff Get?
Who Counts as Vacation Staff
- A Vacation Department is a department, or part of one, that is allowed regular vacations during which its staff may be absent from duty (CCS (Leave) Rules 1972, Rule 3(1)(m), p. 5).
- In Kendriya Vidyalayas, all categories of teachers, librarians, and laboratory assistants, attendants and Group D staff are vacation staff. The Principal is non-vacation staff, and the post of Vice-Principal is treated as both (KVS Education Code, Article 66, p. 43).
Your Basic Earned Leave Credit
- Your leave account is credited in advance with 5 days of earned leave on 1 January and 5 days on 1 July each year (CCS (Leave) Rules 1972, Rule 28(1)(a), p. 21).
- For this rule, a "year" means twelve months of actual duty in a Vacation Department, not a calendar year (CCS (Leave) Rules 1972, Rule 28, Explanation, p. 21).
Extra Earned Leave When You Lose Vacation
- In a year in which you take only part of the vacation, you get additional earned leave in proportion to 20 days, as the days of vacation not taken bear to the full vacation. Total earned leave credited cannot exceed 30 days in a calendar year (CCS (Leave) Rules 1972, Rule 28(1)(b), p. 21).
- Example: if the full vacation is 50 days and you are kept on duty for 10 of them, the extra leave is 10/50 x 20 = 4 days.
- You are treated as having taken the vacation unless a higher authority required you, by general or special order, to give it up. If such an order prevented you from enjoying more than 15 days of the vacation, you are treated as having taken no vacation (CCS (Leave) Rules 1972, Rule 28, Note 1, p. 21).
- If you take no vacation in a year, your earned leave is worked out under Rule 26 (15 days each January and July) instead (CCS (Leave) Rules 1972, Rule 28(1)(c), p. 21).
Combining Vacation With Leave
- Vacation may be taken with or in continuation of any kind of leave. But vacation and earned leave taken together cannot exceed the earned leave admissible at a time under Rule 26 (CCS (Leave) Rules 1972, Rule 28(2), p. 21), which is 180 days for a government servant employed in India (CCS (Leave) Rules 1972, Rule 26(2), p. 19).
- Your earned leave balance can be carried forward up to 300 days (CCS (Leave) Rules 1972, Rule 28(3), p. 22).
- Unavailed joining time can also be credited as earned leave for vacation staff (CCS (Leave) Rules 1972, Rule 28(3), Note, p. 22), up to 15 days reduced by the joining time actually availed (CCS (Leave) Rules 1972, Rule 26(1)(a)(ii), p. 18).
